WHAT IS THE FEDERAL EMPLOYERS' LIABILITY ACT?
 In 1908 Congress passed the Federal Employers' Liability Act, providing railroad employees and their families certain rights in the event of an on duty injury or death. The FELA allows railroad workers and their families to recover compensation for medical and hospital expenses, wage loss, emotional distress, pain and suffering, and disability.
These rights, however, come with certain requirements. Under FELA it is the injured person's responsibility to prove negligence or fault of the railway. Many times, the railroad defends such cases by attempting to prove the injured employee was responsible for his/her own injury. As a result, when an employee is injured the railroad and the injured employee become adversaries.
